These Terms & Conditions ("Terms") govern your access to and use of the Faaya suite of applications ("Service"), operated by Faaya Astu Pvt Ltd ("Company", "We", "Us").

By accessing or using the Service, you agree to be bound by these Terms.

1. Overview of Service

Faaya is a digital platform that enables merchants to:

  • Create and manage digital garment collections
  • Scan fabrics and build virtual inventories
  • Offer virtual try-on experiences using avatars, backgrounds, and poses
  • Share curated fitting rooms with customers
  • Create marketing content

Faaya is intended for business use by merchants, and for their customers.

2. Accounts & Access

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity under your account.
  • We reserve the right to suspend or terminate accounts for misuse or violation of these Terms.

3. Subscription & Access Control

Access to features is governed by subscription plans assigned by Faaya or its authorized administrators.

Subscription allocation, upgrades, and renewals are managed externally by Faaya or authorized personnel.

We reserve the right to:

  • Modify plan limits (e.g., scans, fitting rooms, devices)
  • Introduce new pricing or plans
  • Restrict or suspend access if limits are exceeded or terms are violated

4. Usage Limits

Depending on the assigned plan, usage may be limited by:

  • Number of fabric scans
  • Number of avatars or fitting rooms
  • Device access
  • Availability of premium features

Exceeding limits may result in:

  • Temporary restriction of features
  • Requirement to upgrade the subscription

5. Content & Intellectual Property

User Content

You retain ownership of:

  • Uploaded images
  • Scanned fabrics
  • Created garments and collections

By using the Service, you grant Faaya a limited, non-exclusive license to:

  • Process, display, and store your content for providing the Service
  • Improve platform functionality and recommendations

Faaya Content

All platform elements including:

  • Software
  • UI/UX
  • Pre-built assets (avatars, poses, backgrounds)
  • Premium garments

are owned by Faaya and may not be copied, redistributed, or reused without permission.

6. Sharing & Public Content

  • Merchants may share fitting rooms and try-on experiences via links.
  • Shared content may be accessible to third parties depending on visibility settings.
  • Merchants are responsible for ensuring that shared content does not violate any laws or rights.

7. Acceptable Use

You agree not to:

  • Upload unlawful, harmful, or infringing content
  • Misuse the platform for unauthorized commercial purposes
  • Attempt to reverse engineer or exploit the system
  • Use the platform in a way that disrupts other users

8. AI & Recommendations

Faaya may provide:

  • Style suggestions
  • Garment recommendations
  • Design insights

These are generated automatically and should be considered assistive tools, not guarantees of outcomes or sales.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy.

We collect and process data to:

  • Provide and improve the Service
  • Enable personalization and recommendations
  • Monitor usage and performance

10. Termination

We may suspend or terminate access if:

  • You violate these Terms
  • There is suspected misuse or fraud
  • Required by law

You may stop using the Service at any time.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Faaya is provided "as is" without warranties
  • We are not liable for indirect, incidental, or consequential damages
  • We do not guarantee uninterrupted or error-free service

12. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted within the app or on our website.

Continued use of the Service constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in Punjab, India.
